1. Introduction

In CargoShare (hereinafter referred to as “CargoShare”, “ our Company”, “we”, “us”, “our”) we respect the privacy of all individuals and we are committed to the security and protection of the personal information of the visitors and registered members (collectively the “Users”) to our Website and/or our Platform platform.cargoshare.org

The present Privacy and Cookie Notice has been prepared based on the provisions of the applicable data protection legislation, including Art. 13/14 of Regulation (EU) 2016/679 (“General Data Protection Regulation”) and the Greek Law 4624/2019. It applies to and concerns any personal data that might be collected and processed by CargoShare in order to enable the operation of the CargoShare Website and/or Platform and more specifically whenever a User interacts with it and/or creates an account and contains a description of all personal data processed by CargoShare, the legal basis for such processes, the purposes for which we use the personal data collected, to whom we may disclose them and the relevant rights you have as a data subject under the applicable data protection legislation.

Whenever the company provides the services directly to legal entities, such Users shall be not data subjects and any personal data that could be processed belong either to employees or officers of such legal entities.

The present Notice forms an integral part of our Terms and Conditions of Use which regulates the use of the CargoShare Website and/or Platform. This Notice relates solely to the CargoShare Website and/or Platform and the services offered herein, if not stated otherwise within this document and does not apply to your use of any of our other additional services which might be subject to different Privacy Notice as described therein

CargoShare strives to always keep your personal data safe and comply with all applicable data protection provisions as each time in force. We shall not at any time, receive from you more personal data than what is necessary for each purpose for which they are collected, and we will not use your information for any purpose incompatible with the scope of our services as described in our Terms and Conditions of Use and we will not share your personal data with anyone except as described in this Privacy and Cookie Notice.

2. Amendments to the present Notice

We may update the present Notice at our discretion, from time to time, for example to comply with new obligations imposed by the applicable legislation or regulations, and therefore we ask you to check periodically for the latest version of the Notice, as indicated in the “Effective Date” at the bottom of the page. If there will be any significant changes made to the use of your Personal Information (as defined herein) in a manner different from that stated at the time of collection, we will notify you by posting a notice on our Website    and/or Platform and whenever it is required as per the data protection legislation we will ask for your consent.

4. Personal Data We May Collect About You:

The term “personal data” used in the present notice has the meaning defined under GDPR and is any information related to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly. Such data do not include information that is anonymous.

Our Company may collect and process various types of personal data about you when you use the CargoShare Website and/or as described in this Notice. More specifically, we might collect the following categories of personal data:

Personal Data you submit to us when you register to the CargoShare Website and/or Platform and you create an account or update your account and set your preferences: For example, we will collect your name, surname, contact data such as your email, mobile phone nr. VAT nr. as well as your selected password in order to create an account in the Platform. Without this data, you cannot create an account and enjoy the full features of the CargoShare services that we offer. The e-mail you provide during your registration may be used for the verification and activation of your profile, any communication regarding issues with your account, to send you engagement e-mails regarding various matters of your account (e.g.reminders for subscription payments) and/or in order to send a relevant informative e-mail (newsletter) if you have given us your relevant consent. The mobile phone nr. you provide during your registration may be used for any communication regarding issues with your account, (e.g.reminders for subscription payments) and/or for marketing purposes if you have given us your relevant consent whenever it is required by the applicable legislation.

If you are a Company we might collect personal data and contact details of individuals authorized representatives or employees using the Platform on behalf of their Organizations. Personal Data processed when you make use of the CargoShare services: When you use the services offered by our Website and/or platform and especially when you register we might obtain access to personal data that might be contained in the email communications which the CargoShare Parser system processes in order to extract and analyze the important information to be transferred to the CargoShare platform. Users are urged to give access to the CargoShare Parser system to email communications folders that do not contain any personal data. Cargoshare shall not process any information contained in the emails that is not relevant or necessary to the services provided by CargoShare.

Personal Data contained in your communication with us: Personal data such as your name, surname, e-mail address, or any other information about you that might be contained in communications you send to us for inquiries, complaints and other requests through our channels of communication (for example when you send us an e-mail or when you use the contact form available on our Website).

Financial Data: Whenever applicable to an individual, we might collect billing information relating to payments in the course of subscriptions to the CargoShare Website and/or Platform.

Personal Data collected automatically using cookies or other tracking technologies: This data includes personal data collected automatically by the CargoShare Website and/or Platform i.e. usage data relating to User access to the Website and/or Platform which constitutes information collected as transmitted by the browser on our server e.g. record and store logs about detailed usage of our services by each User, the IP addresses of your browser software and version, your operating system, the reference source, the duration of your visit, device information, access data, device ID, time and duration of connection, frequency of use, means of connection, etc. and other information of this kind. This data is collected solely for the purpose of serving the correct and fast operation of the Website and/or Platform provided through it and to improve its functions as well as to guarantee its stability and security. Furthermore, we may receive some of the aforementioned technical data from analytics providers such as Google. We use this information for our internal analytics purposes and to improve the quality and relevance of our Website and/or platform to our Users.

The above information is not collected to be associated with identifiable persons, but because of its nature, it could allow users to be identified by processing and linking to data held by third parties. For more details on data collected automatically, through the use of cookies, - or other similar tracking technologies - by us or third-party services used by the CargoShare Website and/or platform, please refer to Article 10 below.

Information that CargoShare does not collect: CargoShare does not collect or process any special categories of personal data.



5. For what purposes do we collect information about you and on what legal basis?

Whenever we process personal data, we always do so on a lawful legal basis for such processing. We may process Personal Data relating to our Users solely if one of the following applies:

If the use of your Personal Information is necessary for the performance of the agreement we have concluded with a User and/or for any pre-contractual obligations thereof; including the creation of a User account, maintaining and managing the registration of a User, processing invoicing and in general for the general management and satisfaction of any requests of the Users regarding the services we provide and providing users with customer service, answers to questions, feedback, demands and claims; You understand and agree that CargoShare personnel might view then the content of your data and/or email and other items as necessary to respond to your specific support requests

If processing is necessary for our legitimate interests (or interests of a third party) that are not overridden by your interests and fundamental rights, including indicatively the operation, maintenance, security and the improvement of our Platform and of the Users’ experience, the verification of your identity, observing the usage logs and the trends to analyze and detect any misuse of our Website and/or platform, assessment of the security of the Users accounts and the risks of User transactions for the detection and prevention of fraud and other security threats and the processing of your inquiries or the establishing, exercising or defending of legal claims. In these cases, we will look after your information at all times in a way that is proportionate and respects your privacy rights and you have a right to object to processing as explained in “Your Rights” section below;

If processing is based on users’ prior explicit consent for one or more specific purposes, e.g.on sending our Newsletter to Users about products, services they may be interested in.

If processing is necessary for compliance with a legal or regulatory obligation to which we are subject (e.g. the disclosure of information to law enforcement or tax authorities).

6. CargoShare Newsletter:

When you visit our Website and/or platform you have the option to register in order to receive our Newsletter. By filling out our form, you give us your explicit consent to process your e-mail for the purpose of periodically sending you our newsletter that may contain news, updates, information about the services we provide as well as information about new products or services we might develop in the future.

To protect privacy rights and to ensure you have control over how we manage marketing activities with you:

we will take steps to limit marketing to a reasonable and proportionate level and only send you communications which we believe may be of interest to you;

If you no longer wish to receive the CargoShare newsletter you can ask us to stop sending marketing emails to you, by following the ‘unsubscribe’ link you will find on all the email newsletters we send you. Alternatively, you can contact us at [email protected] withdrawal of consent does not affect the legality of the personal data processed up until the point of revocation.

7. With whom we might share personal information?

As part of the overall operation of the CargoShare Website and/or platform and to achieve the objectives described in the previous paragraph, your personal data will be available and may be disclosed to our employees and third party service providers, who will operate as authorized entities to process your personal data, always in a way that ensures that your personal data and the information we collect about you are not subject to illegal processing. Specifically, we may share personal data and information we collect about our users:

With third-party subcontractors and/or our service providers who may provide on behalf of our Company technical and operational services, such as but not limited to hosting, technical support, and e-mail delivery services or other support services from time to time, strictly for the purpose of providing their services to us. To the extent that these service providers act as our “data processors” they also have a legal obligation under GDPR and towards CargoShare to protect your personal data and to use it only to provide the agreed service.

With our payment services provider, Viva Wallet. CargoShare does not collect or store information related to payment such as credit card numbers or account details. This information is sent exclusively and directly to the provider who is processing the payment. The Terms of Use and Privacy Policy of our payment provider apply when payments for subscriptions are made through the Website.

With our consultants, including financial, legal and other consultants,

With any supervisory and control organization or any other state authority or public service.

With anyone else only with the prior written consent of our Users unless other legal basis is provided by the applicable data protection legislation.

If CargoShare sells or transfers all or any of its business assets to a third-party, personal data associated with such assets will be disclosed to the third-party buyers.

Furthermore, we will also respond to requests for personal data where required to do so by law, or when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, request from a regulator or any other legal process served on us.

8. Transfer of data outside of the European Economic Area (E.E.A.):

We process your personal data at our operating offices and in any other place where the parties involved in the processing, such as our subcontractors, are located. As a result, depending on the User's location, data transfers may involve transferring of User's Data to a country other than their own. If such transfer takes place to a third-country outside of the EU/EEA area in the context of and for the needs of the above-mentioned purposes, and the third country does not provide an adequate level of security of the personal data, the personal data will be transferred to that country only if the protection of data is guaranteed by a data transfer agreement based on Standard Contractual Clauses or by any other condition explicitly provided by European or local law.

9. Retention time (How long do we keep your data?)

Our Company retains your personal data for as long as is reasonably necessary for the purposes for which they were collected, as described in this Notice. Generally, we retain your personal data only if your account is active or for as long as is necessary for us to provide our services. If you delete or deactivate your account in the Website and/or platform we will remove your personal data subject to the next paragraph below, at the latest within six (6) months. We may retain the Personal Data for a longer period of time whenever the User has given us consent to such processing, provided that such consent has not been revoked or until you ask us to delete or modify your personal information which is stored by us. Furthermore, we may be required to retain Personal Data for a longer period of time whenever required to fulfill a legal, regulatory, fiscal or accounting obligation or as mandated by an authority or if we need your personal data to establish, exercise or defense of legal claims.

Once the retention period expires, Personal Data will be deleted or anonymized. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period. In cases where the Company maintains information to improve and develop the Website and/or platform, the Company takes steps to eliminate information that directly identifies the User or anonymizes such information.

Our Website and platform uses cookies. CargoShare Users may exercise certain rights regarding their personal data processed by CargoShare:

Right of information We must provide you with all the necessary information regarding the processing of your personal data (including as to what data are being processed, for what purposes, how long the data will be stored) in a concise, transparent, easy to understand and easily accessible format, using clear and plain language. This is the purpose of the present Notice.

Right of access You have the right to obtain from us confirmation as to whether or not personal data concerning you are being processed and, where that is the case, you have the right of access to such personal data and obtain a copy of the data undergoing processing, or of related information regarding such processing if not covered within the present Notice.

Right to rectification You have the right to verify the accuracy of your data and request from us the rectification of inaccurate personal data concerning you and the completion of incomplete information about you.

Right to erasure You have the right, under certain circumstances, to request the erasure of your personal data when the data is no longer necessary for the purposes for which they were collected or processed, or you have revoked your consent and there is no other legal basis for processing or when you have successfully objected to the processing of your personal data, or when the data has been processed illegally, or when the data must be deleted in order to fulfill a legal obligation.

This provision is applicable provided that the Data is processed by automated means and that the processing is based on the User's consent, or a contract which the User is part of or on pre-contractual obligations thereof.

Right to withdraw consent You have the right at any time to withdraw your consent whenever consent is the legal basis for processing your personal information

Exercising your Rights: For further information regarding your rights, or in order to exercise any of your rights, or if you have any complaints or questions regarding the processing of your personal data please contact us at [email protected]. These requests can be exercised free of charge and we will reply as soon as possible. In general, we reply to your requests within one (1) month of when we received the request, but if the request requires more time then we will inform you accordingly (within one month). Please note that we may request proof of identity, and we reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive.

13. Children’s privacy

We will not knowingly collect, any personal information from any person younger than minimum legal age as defined by the applicable data protection legislation. If you are younger than the minimum legal age please do not use or provide any information on this website and/or platform or through any of its features, and do not give any information about you to us, including your name or your e-mail address.

If we find that we have collected or received personal data from a minor we will delete such information.
